Democratically Restricting Rights

Much attention is being paid – and rightly so – to a law that was recently passed in Afghanistan that critics are saying legalizes ‘marital rape’. The law essentially allows a husband in Afghanistan to demand sex from his wife at least every four days with some restrictions. A top Afghan cleric justified the law with the following remark:

“The westerners claim that they have brought democracy to Afghanistan. What does democracy mean? It means government by the people for the people. They should let the people use these democratic rights,” Mohseni told reporters in the capital, Kabul.

That’s right, as long as you got the vote then you are good to go. The majority demands to restrict the rights of some class of people. Where have we seen this before? This is the same principle by which California removed the ability of homosexuals to marry. Democracy does not mean tyranny by the majority any more than it means tyranny by a magic book:

Afghanistan is an Islamic state and its constitution defers to the Qur’an as the ultimate authority. Mohseni said the law simply reiterates rules from Islam’s holy book.

As we all saw with the passage of Proposition 8, a very similar mentality undoubtedly exists right here in the United States.
